Terms of service

These Terms of Service ("Terms") govern all sales of goods by Coffee Artists Pty Ltd ("Coffee Artists", "we", "us") through this store and by direct wholesale arrangement. By placing an order you agree to these Terms.

1. Who we sell to

We are a wholesale-first roastery supplying cafés, grocers, chains, QSR and offices, as well as Bean Streams subscribers and retail customers. Some provisions below apply only to approved wholesale accounts.

2. Orders

All coffee is roasted to order. An order is accepted when we confirm it or dispatch the goods, whichever comes first. Standing (recurring) wholesale orders continue at the agreed volume and cycle until you change or cancel them; changes should reach us before your next roast cycle. We may decline or limit any order at our discretion.

3. Pricing

All prices are in Australian dollars. GST is applied where applicable. Wholesale pricing (including volume tiers) is as published or as agreed on your account. We may update pricing with reasonable notice; price changes do not affect orders already confirmed.

4. Payment terms

Unless otherwise agreed in writing, payment is due at the time of order.

Approved wholesale accounts: invoices are payable within 30 days of the invoice date (Net 30). New wholesale customers are on payment-with-order until a trading account is approved. We may suspend supply on overdue accounts, withdraw credit terms at any time, and recover reasonable costs of collecting overdue amounts.

5. Title and risk

Risk in the goods passes to you on delivery. Title in the goods remains with Coffee Artists until payment for those goods has been received in full. Until title passes, you hold the goods as bailee for us and must store them so they are identifiable as ours.

6. Private label & custom blends

You warrant that any branding, artwork or trade marks you supply for private-label packaging are yours to use, and you indemnify us against claims arising from their use. Your branding remains your property. Blend recipes and roast profiles developed by us remain our property; custom blends developed together with you will not be supplied by us to another customer under your branding.

7. Samples

Free sample packs are offered to genuine business customers, one per business, at our discretion.

8. Subscriptions (Bean Streams)

Subscriptions renew automatically on their billing cycle until paused or cancelled. You can pause or cancel at any time before your next billing date. Our Bean Streams contribution pledge — 10% of revenue from every Bean Streams kilo funds clean-water projects — is a voluntary commitment and we report on it publicly.

9. Returns and refunds

Returns and refunds are handled under our Refund Policy, which forms part of these Terms.

10. Liability

Nothing in these Terms excludes, restricts or modifies any right or remedy under the Australian Consumer Law or any other law that cannot lawfully be excluded. Subject to that, our liability for any claim arising out of the supply of goods is limited, at our election, to the replacement or resupply of the goods or the cost of doing so, and we are not liable for indirect or consequential loss.

11. General

These Terms are governed by the laws of New South Wales, Australia, and the parties submit to the non-exclusive jurisdiction of its courts. If any provision is unenforceable it is severed and the rest remain in force. We may update these Terms from time to time; the version published at the time of your order applies.
